WAIVER

1. Assumption of Risk

Participation in activities at Smash Padel Club Doral LLC (DBA as Ola Club) (“Club”), located at 8135 NW 56 Street, including but not limited to padel, pickleball, and use of social areas (the “Activities”), involves risks.

These risks include, but are not limited to: physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death.

These risks may arise from my own or others’ negligence, conditions related to travel, the condition of the Club’s premises, or the actions of other participants, volunteers, spectators, coaches, event officials, and event monitors.

I knowingly and voluntarily assume all such risks, whether known or unknown, including travel to, from, and during these Activities.

2. Release of Liability

I hereby release, discharge, and hold harmless Smash Padel Club Doral LLC (DBA as Ola Club), its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns from any and all claims, causes of action, or liability of any kind—whether for personal injury, property damage, illness, paralysis, death, or other damages—arising out of or related to my participation in the Activities, including travel to and from the Activities, whether caused by negligence or otherwise, to the fullest extent permitted by law.

3. Indemnification

I agree to indemnify and hold harmless Smash Padel Club Doral LLC (DBA as Ola Club) from any and all claims, suits, or actions of any kind for liability, damages, compensation, or otherwise, including attorneys’ fees and costs, brought by me or anyone on my behalf. If the Club incurs any of these expenses, I agree to reimburse the Club in full.

4. Medical Treatment

If I require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I understand that I should carry my own health insurance.

5. Property Damage

I acknowledge and agree that I will be held liable for any damage to equipment or facilities caused by my or my family’s willful actions, neglect, or recklessness, and will reimburse the Club for all associated costs.

6. Photo/Video Release

I grant permission for images or video of myself (and, if applicable, my minor child) captured at Smash Padel Club Doral LLC (DBA as Ola Club) through photography, video, or digital media to be used solely for the Club’s promotional materials and publications.

I waive any rights of compensation or ownership and understand that these images or recordings shall be the sole property of the Club.

7. Governing Law and Venue

This Waiver and Release shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under this Waiver shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.

8. Severability

If any provision of this Waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

9. Acknowledgment of Understanding

I have carefully read this Waiver and Release and fully understand its contents. I am aware that this is a release of liability and a contract and I agree to it voluntarily.

10. Minors

If the participant is under eighteen (18) years of age, the parent or legal guardian of the minor participant expressly consents to the minor’s participation in the Activities and agrees to all terms, conditions, releases, indemnifications, and waivers set forth in this document on behalf of the minor.
