Please use this form to authorize P&V International Sport Kids to set up recurring credit card billing for services that we provide to you.

Authorization

I hereby authorize P&V International Sport Kids  to charge the indicated credit card for MONTHLY PAYMENTS on the first 5 day of each month for the services provided and any applicable cancelation fees.  I agree that this is a periodic charge that will be made according to my billing cycle. I must cancel my account within 5 days prior of recurring payment.  I guarantee  that I am the legal cardholder to use it at P&V International Sport Kids

P&V INTERNATIONAL SPORT KIDS

ATHLETIC WAIVER OF LIABLITY AND HOLD HARMLESS AGREEMENT

I hereby release P&V INTERNATIONAL SPORT KIDS  and its representatives, affiliates, officers, agents, employees, members, directors, volunteers, and attorneys, from any and all liability or claims that may be sustained by the Player, or a third party directly or indirectly in relation to, or arising from, Player’s  participation in the activity described in this document, whether caused, in whole or in part, by the negligence of  P&V INTERNATIONAL SPORT KIDS or otherwise, including any responsibility for recruitment not allowed during the current sport season.

I certify that the Player is fully covered by medical insurance and that I am fully responsible for all costs incurred, whether covered by a policy or not. I further certify that Player is in good health and free of injury.

I understand that there are certain inherent risks associated with participating in sports and/or athletic training that cannot be eliminated. These risks include but are certainly not limited to: (1) minor injuries such as scratches, cuts, bruises and strains; and (2) major injuries such as injuries to the eyes, infection, loss of sight, joint injuries, back injuries, heart attacks, concussions, paralysis and even death. Also included in these risks are the same or similar injuries that might result from using training equipment, actual use of a field or training facilities, the acts of others or from the unavailability of emergency staff or emergency medical care (hereinafter we shall define all of these risks and potential injuries as “Risks”). All of these Risks will be present in the activities that you and/or your minor will be participating with P&V INTERNATIONAL SPORT KIDS (the “Activities”).

I, on behalf of myself and/or my minor, ASSUME ALL OF THE RISKS THAT MAY OR CAN ARISE OUT OF PARTICIPATING IN THE ACTIVITIES, INCLUDING BUT NOT LIMITED TO THE ATHLETIC ACTIVITY ITSELF, USE OF THE EQUIPMENT, FIELD OR FACILITIES, THE ACTS OF OTHERS OR THE UNAVAILABLITY OF EMERGENCY CARE, as well as those Risks described in the preceding paragraph.

I, on behalf of myself and/or my minor and/or our heirs, personal representatives and/or assigns, also agree to indemnify and hold P&V INTERNATIONAL SPORT KIDS, its affiliates, subsidiaries, assigns, partners, attorneys, members, employees, independent contractors, shareholders, officers, directors, and agents or any producers, investors, or any other person or entity associated in any way with the ownership, operation or affiliation with recreational facilities and the creation, production or distribution of P&V INTERNATIONAL SPORT KIDS -related marketing content on any P&V INTERNATIONAL SPORT KIDS -owned website, harmless from any and all claims, causes of actions, lawsuits, arbitrations or proceedings as well as from any expenses, judgments, costs, fees, damages, expenses and/or liabilities, including attorneys’ fees incurred in defending or prosecuting any such claims brought against P&V INTERNATIONAL SPORT KIDS as the result of my or my minor’s participation in the Activities. I hereby allow P&V INTERNATIONAL SPORT KIDS to use my or my minor’s image or likeness without current or future compensation for marketing purposes related to P&V INTERNATIONAL SPORT KIDS

I, on behalf of myself and/or my minor and/or our heirs, personal representatives and assigns, in consideration for being permitted to participate in the Activities HEREBY RELEASE, WAIVE AND DISCHARGE P&V INTERNATIONAL SPORT KIDS

from any and all liability associated with or related to my or my minor’s participation in the Activities and agree NOT TO SUE P&V INTERNATIONAL SPORT KIDS for any reason resulting from or associated with my or my minor’s participation in the Activities. This waiver and release is intended to include all claims for injuries, accidents, illnesses, or property loss, whether known or unknown or anticipated or unanticipated, which are in any way related to or associated with the Activities.

I,  on behalf of myself and/or my minor, acknowledge that P&V INTERNATIONAL SPORT KIDS is not obligated and therefore may not to carry insurance on behalf of myself or my minor.

I, on behalf or myself and/or my minor, understand and acknowledge that I/we are surrendering valuable legal rights in this agreement.

I am the parent and/or legal guardian of the above-named minor participant. I HAVE READ AND HAVE an appreciation for and an UNDERSTANDING OF THESE RISKS, and affirm that the Player is a minor and his/her participation in these Activities is voluntary. I understand that I am surrendering legal rights on behalf of the minor and myself. I, on behalf of myself and my minor, agree to be bound by all the terms of this agreement and give my consent to allow the minor Player to participate in the Activities described herein. I release and agree to indemnify and hold harmless the Releasees from any kind and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, even if arising from the negligence of the releases to the fullest extent permitted by law.

P&V INTERNATIONAL SPORT KIDS CONTRACT RULES AND REGULATIONS

(the “Player”). The Academy, the Parent and the Player shall collectively be referred to as the “Parties.”

RECITALS

WHEREAS, the Academy is a initiation and development soccer team; and

WHEREAS, the Academy works on developing the technical, psychological, and tactical aspects forming the individual and group aspects of the Player.

WHEREAS, the Academy will provide sports training to each player who is duly registered and current in the payment of the monthly and tournament fees.

WHEREAS, the Parent desires to register the Player to train and play soccer with the Academy under the terms and conditions set forth in this Agreement; and

WHEREAS, the Academy desires to accept the Player in its team under the terms and conditions set forth in this Agreement;

NOW THEREFORE, in consideration of the foregoing, exchange of mutual agreement, benefit, and obligations recognized in this Agreement, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

The academic season begins on AUGUST of every year, being operational every month except SPRING BREAK, WINTER BREAK, national holidays, and previously notified days; Season ends on the last day of JULY of each following year.

The Academy has the following internal structure:

Coordinator: Who oversees the structure of the program, as well as ensuring compliance with the program. He will also oversee the trainings of the players and training of the coaches and volunteers who become part of the academy

Operational Director: Who will handle the administrative part, and relationship with parents and representatives, tournaments, and activities related to the academy and its operation.

Player and Parent shall comply with the following regulations:

REGULATIONS

1. PLAYERS

1.1 Player shall attend all events on time (training, civic and sporting events to which it is convened by the Academy). 

1.2 Player shall attend the events in the necessary implements and full official uniform, football shoes. Wearing the official uniform is mandatory in all training and parties held by the Academy, including official training and civic or sport events. Attending to an event without the official uniform is grounds for suspension.

1.3 Player shall maintain impeccable decorum on and off the training ground, as in all matches, respecting game rules, referees, opponents and the general public.

1.4 Player shall respect any and all differences between players. Player will be subject to sanctions if his/her actions physically or psychologically affect another player.

1.5 Player shall respectfully comply with the direction and instruction of the coach(es). 

1.6 Player must always use respectful language, avoid fights and clashes between peers and/or players from other schools. 

2. PARENTS/LEGAL GUARDIANS

2.1.1. Be on time to the training, civic, and sporting events scheduled by the Academy; 

2.1.2. Negative, demeaning or inappropriate comments (at the sole discretion of the Academy) towards other players, parents, coaches, or others are not allowed. Physical or verbal aggression is absolutely forbidden.

2.1.3. If you require an appointment regarding the player’s development or any other concern, such request should be submitted via email at pvinternationalsportkids@gmail.com.

2.1.4. Training cannot be interrupted. Comments and questions shall be directed via email to the coach and administration who, at its discretion, will coordinate a zoom meeting to discuss questions and concerns.

2.1.5. Parent shall keep distance inside the field and avoid giving instructions to the players.

2.1.6. Parent and family members should always show an exemplary attitude during practices, supporting and encouraging our team using the appropriate language and voice tone.

2.1.7. Parent shall accept decisions made by coaches or coordinators regarding Player.

2.1.8. Parent shall comply with payments and scheduled fees, regardless of the Player’s absence. NO EXCEPTIONS (Illness, injury, personal reasons).

2.1.9. Player shall be on time to all civic and sporting events scheduled by the Academy.

2.1.10. Parent and family members shall always show an exemplary attitude during games, supporting and encouraging Academy players using the appropriate language and tone of voice.

2.1.11 Player will be subject to disciplinary action if Player does not comply with the aforementioned rules.

2.1.12. In the event that Player’s contract is terminated as a consequence of a non-compliance of these aforementioned rules, at the sole discretion of the Academy, Parent shall remain responsible for pending payments.

3. PAYMENT OF FEES

3.1.1. The registration payment shall be made in full within immediately the signing of this Agreement.

3.1.2. Monthly payments, are due on the first of each month.

3.1.3. Payments are considered late if not paid by the 6^th day of the month and will incur a late fee of $50.00 per month until paid.

3.1.4. A Player that is past due on assessments can, at the sole discretion of the Academy, not be allowed to participate until the account is current, including the payment of any late fee.

3.1.5. Payment must be made on the date established by the administration. If you want to cancel the monthly payment you should send a letter to pvinternationalsportkids@gmail.com 5 days before the monthly payments of each month.

3.1.6. Payments are non-refundable. NO EXCEPTIONS (Illness, injury, personal reasons).

3.1.7. Parent has the obligation to pay the fees established on the scheduled date.

3.1.8. Non-payment and past due accounts will be submitted to the attorney and Parent will be responsible for legal fees and costs incurred in the collection of unpaid assessments.

4. CONTRACT TERMINATION AND RELEASE

Player’s contract can be terminated during the season if the account is paid in full, including mandatory and confirmed events and monthly payments

5. UNIFORMS

5.1.1. Parents must purchase the complete uniform kit, which has an additional cost. Player must train and participate in events and games wearing a complete uniform. No uniform, no play. No exceptions.

5.1.2. The Uniform must have been paid for Player to participate in training, or any event.

5.1.3. The uniforms shall be paid in full at the time of the purchase.

5.1.4. Uniforms cannot be modified without the written consent of the Academy, which can grant consent at its sole discretion.

5.1.5. Uniforms will change YEARLY. Parents must purchase it every year on the stipulated day.

6. MISCELLANEOUS

6.1.1. Applicable Law, Jurisdiction, Attorneys' Fees. This Agreement shall be governed by, construed, and enforced pursuant to the laws of the State of Florida, USA, without giving effect to its conflict of law provisions. Any judicial proceeding brought by either Party to enforce or interpret this Agreement, or the Exhibits and Exhibits attached hereto, if any, shall be brought in the appropriate court in Miami-Dade County, Florida. By executing and delivering the Agreement, each Party to this Agreement consents to the exclusive jurisdiction of the courts and waives any objections to jurisdiction therein. The prevailing Party in any such proceeding shall be entitled to an award of its legal fees and costs incurred and at every level of a litigation and in any proceeding, including bankruptcy court and appeals as applicable.

6.1.2. Assignment of Agreement. This agreement is not assignable without the written consent of the Parties.

6.1.3. Contents of the Agreement. This Agreement sets forth the entire understanding of the Parties hereto with respect to its subject matter. It shall not be amended or modified, except in writing and executed by both Parties, and no provision hereof shall be waived, except by a written instrument duly executed by each of the Parties hereto. Any and all prior written agreements and understandings between the Parties with respect to the subject matter hereof, whether written or oral, are superseded by this Agreement.

6.1.4. Unenforceability, Severability. If any provision of this Agreement is found by a court of competent jurisdiction to be void or unenforceable, the remaining provisions of this Agreement will nonetheless be binding on the Parties with the same force and effect as if the unenforceable portion had been severed and deleted.

6.1.5. Acknowledgment of Trades. The Parties acknowledge and agree that: (a) each had sufficient time and opportunity to consult with counsel of their own choosing regarding the terms of this Agreement and the legal implications thereof; (b) this Agreement has been prepared, reviewed and entered into without duress, fraud, or undue influence and without circumstances beyond the free will of the signatories; and (c) this Agreement is made expressly with each Party acting as an equal to the other Party and, accordingly, any rules of interpretation to the effect that any ambiguity shall be resolved against the drafting party shall not be used in the interpretation of this Agreement.

6.1.6. Acceleration; Remedies. Upon the occurrence of any breach of this Agreement, by the Player or the Parent, the Academy may, without notice or demand, exercise its rights provided herein and all such rights and remedies shall be cumulative and concurrent and may be pursued singularly, successively or concurrently, at the Academy's sole discretion, including but not limited to declare the amount due to the Academy payable here under to be immediately due and payable, without presentment, demand, protest, or further notice of any kind, all of which are hereby expressly waived by Parent, or initiate a lawsuit to enforce the terms of this Agreement to collect all sums due hereunder, including pre-trial, trial and appellate level attorneys' fees and costs.

I have read the rules and am willing to comply with the provisions, understanding that the accumulation of 3 sanctions will compromise the permanence of the Player in the Academy.

have read and understood the contract of P&V INTERNATIONAL SPORT KIDS and I agree to be part of the club.
